During a pandemic, where there is widespread human infection, various and varying measures are taken that are targeted at public health objectives. During the early stages of a pandemic, these objectives may focus on containing the disease and minimizing its spread, but they may switch to mitigation as the emergent infectious disease takes hold in a population. There has been considerable debate and elucidation of the ethical principles and framework for the various responses including the need to fast track research (...) and vaccine development. However, the measures imposed during a pandemic would have unintended and untoward effect on ongoing clinical research. For example, precautionary measures, such as social distancing, may hamper ongoing clinical research, because recruitment and participation of patients and healthy volunteers is a potential source of virus spread. In this paper, we argue that a framework is needed to ensure the continuity of such research. Such a framework that considers the pertinent issues would need the ‘buy in’ of the key stakeholders (policy makers, funding agencies, institutional authorities, researchers and subjects) to ensure that the issues that are ethically relevant to pandemic planning would not be neglected or overlooked. Edwards wrote to me that he accepted ‘this very helpful analysis of the trouble', but not my emendation, on the ground that O.'s admission of failure would be ‘a factual statement requiring ’.

identity theory , usually attributed to J.J.C. Smart (Smart, 1959) and U.T. Place (Place, 1956), claimed that kinds of mental states are identical to kinds of brain states. Sensations of pain, for instance, were said to be identical to the firing of C-fibres or some such type of neurological state. According to this view, then, pain, conceived as a _kind_ of mental state, is said to be _reduced_ to a certain kind of neurological state. The reduction envisaged here was modelled (...) on the kind of reduction seen in other areas of the sciences. For instance, lightning can be said to be reduced to a rapid discharge of electrons in the atmosphere. The use of multiple means of determination to “triangulate” on the existence and character of a common phenomenon, object, or result has had a long tradition in science but has seldom been a matter of primary focus. As with many traditions, it is traceable to Aristotle, who valued having multiple explanations of a phenomenon, and it may also be involved in his distinction between special objects of sense and common sensibles. It is implicit though not emphasized in the distinction between (...) primary and secondary qualities from Galileo onward. An experimenting society is one in which policy-relevant knowledge is created. It is then critically assessed and communicated in real-life or natural settings, with the aim of discovering new forms of public action to improve the problem-solving capacities of society. This latest volume of the distinguished Policy Studies Review Annual series probes, evaluates, and augments the work of Donald T. Campbell on an experimental societies. A basic assumption of this volume is that Campbell's perspective supplies a useful way (...) to address increasingly complex and seemingly unmanageable problems facing the United States and other postindustrial societies. This volume is also the fourteenth festschrift to be issued by Transaction. The focus is on theoretical as well as practical options for creating an experimenting society. The rationale for this focus is the belief, increasingly -shared in the social science and policy-making communities alike, that researchers are essentially ignorant about how to solve many of the most pressing larger problems of this epoch. This frank recognition of ignorance is a prerequisite of genuine scientific and professional curiosity, without which knowledge gains are next to impossible to achieve, and a'precondition of an experimenting society. The publish-or-perish paradigm is a prevailing facet of science. We apply game theory to show that, under rather weak assumptions, this publication scenario takes the form of a prisoner’s dilemma, which constitutes a substantial obstacle to beneficial delayed publication of more complete results. One way of avoiding this obstacle while allowing researchers to establish priority of discoveries would be an updated “pli cacheté”, a sealed envelope concept from the 1700s. We describe institutional rules that could additionally favour high-quality work and (...) publications and provide examples of such policies that are already in place. Our analysis should be extended to other publication scenarios and the role of other stakeholders such as scientific journals or sponsors. (shrink)

The authors present a case study involving truth telling responsibilities in the setting of nonepileptic seizures. Specifically, over the course of several suspected nonepileptic seizures, a patient’s seizures stopped after he received a saline flush meant to precede the administration of anti-seizure medication. The patient and his surrogate believed he had received the medication each time, and the team wondered whether they should disclose the truth. Some worried that disclosure would reinforce the suspected psychogenic behavior, exacerbating the patient’s condition. In (...) this way, the case study presents a twist on the traditional truth telling archetype. While most truth telling cases center on navigating cultural differences or worries about emotional harm, this case presented concerns about medical harm in the form of exacerbating the patient’s condition. The authors describe the complex patient-family-team dynamic that preceded this ethical dilemma, describe the case, analyze the ethical issue, and describe the outcome. (shrink)

In challenging this orthodoxy I am not moved by any particular enthusiasm for Victoriana, nor do I want to revive the view that means simply ‘moral flaw’ or ‘morally wrong action’. I shall (...) try to show that the word has a range of applications, from ‘ignorance of fact’ at one end to ‘moral defect’, ‘moral error’, at the other, and that the modern orthodoxy, though not as clearly wrong as the moralizing interpretation it displaced, restricts Aristotle's meaning in a way he did not intend, and does lessthan justice to his analysis of classical drama. Are experience and stimulus necessarily alike? Wertheimer spoke of this as an “insidious and insistent belief”. By contrast, Watson devotes an entire book to the defense of the thesis that representation necessarily requires resemblance. I argue that this bold and important thesis is ambiguous between a historical and a systematic reading, and that in either one of these readings the thesis, for different reasons, will be found wanting. Second, a proper evaluation of it in either one of its possible interpretations (...) requires a careful analysis of the notion of resemblance. I proceed to supply some necessary distinctions and argue that, given such an analysis, Watson's thesis may be historically applicable only to ancient and medieval philosophy, while its systematic import is untenable. It has long been accepted as a principle by editors and writers on Greek metre that brevis in longo and hiatus in tragic lyrics often coincide with some kind of sense-pause. The object of this inquiry is to determine the incidence of pause in such places, and show that it is significantly high; to show that there is a comparable incidence in the corresponding places in strophic systems; to show that period-ends determined by criteria other than brevis and hiatus are (...) attended by similar conditions. It might seem that if all this were true it would have been recognized long ago, particularly as the connection between sense and metrical structure, and symmetry of sense in strophe and antistrophe, has often been pointed out. Thenοἷον οὔτιν' ἁ Τροί|α στρατοῦ…is possible, but the ithyphallic with word-overlap, sometimes found in the syncopated iambics of Aeschylus, is foreign to Sophocles. It would be generally accepted that G. E. Moore’s celebrated “Refutation of Idealism,” set forth at the turn of the century, constitutes the classic statement of modern realism. The seeming strengths of this position have been elaborated more recently by a notable realist proponent, Don Locke, who, following Moore, takes for granted what is, in effect, the basic assumption of the “Refutation”—the assumption, namely, that each and every variant of the idealist standpoint is embraced under the central Berkeleian contention that (...) “esse is percipi.” It will be my object to argue that the plausibility of Locke’s realism stems from a basic confusion of terms, and that, in its implications, the position becomes vacuous when set in opposition to idealism.
